NAVIGATING CHALLENGING EBA NEGOTIATIONS

Challenge

An independent education institution reached out to Cornerstone for assistance with Enterprise Bargaining (EBA) negotiations following a ‘no’ vote. Communication had broken down due to challenging conversations with union representatives, and each time bargaining would begin there appeared to be miscommunication between the parties that would stall the process, resulting in claims of not good faith bargaining.

Action

The client was seeking the re-commencement of EBA negotiations including assistance to effectively deal with union representatives. Cornerstone participated in EBA meetings with key stakeholders, providing sound advice and guidance to reach an in-principle agreement for each agenda item.

Outcome

Cornerstone maintained open communication with all stakeholders and facilitated the parties reaching an agreement and getting a majority vote in favour of the proposed agreement. Cornerstone also assisted with the application to the Fair Work Commission for approval of the agreement, ensuring all the necessary requirements were met.
